Offering 1.0 hour of CLE credit
Legislation enacted by Congress in July 2025 created “scholarship granting organizations” (SGOs)—a new type of IRC § 501(c)(3) organization whose donors may qualify for a dollar for dollar “Education Freedom Tax Credit” (EFTC). Effective January 1, 2027 (subject to state opt in), SGOs can and fund scholarships covering a broad range of K–12 educational expenses for students. On October 1, 2026, the IRS released the much-anticipated Treasury Regulations in two parts (RIN 1545-BR97 and (RIN 1545-BS17). These regulations interpret the ambiguous provisions of the EFTC and detail what rules SGOs will need to follow to begin receiving donations that qualify for tax credits. Join this webinar to obtain a detailed understanding of the newly released Treasury Regulations, information on what prospective SGOs will have to do to comply with the newly released IRS regulations, how SGOs can position themselves to be listed and certified as an SGO in each state in which it seeks to provide scholarships by January 1, and what additional questions remain.
