About the Event

Host: Derek Early

Please join us via Zoom for a one-hour webinar designed to help you learn how to effectively plan for your business clients. As part of a monthly webinar series offered through WealthCounsel, this presentation will address why it is crucial for both estate planners and drafters of LLC operating agreements to think about how LLC operating agreements, especially transfer of membership interest provisions, impact their clients’ estate planning. We will discuss:

  • how to review a client’s existing LLC operating agreement from an estate planning perspective
  • types of transfer of membership interest clauses in LLC operating agreements
  • why an LLC operating agreement may or may not permit transfers of membership interests to an revocable living trust or an irrevocable trust for estate planning purposes
  • ideas to consider when an existing operating agreement does not permit transfer to a client’s revocable living trust or to an irrevocable trust for estate planning purposes.
