SUMMARY:The New SGO Rulebook: What Code § 25F and the Treasury Regulations Require of Scholarship Granting Organizations - Virtual Event
DESCRIPTION:Presented by: Casey Hale\, and Christian Matozzo \nOffering 1.0 hour of CLE credit \nLegislation enacted by Congress in July 2025 created “scholarship granting organizations” (SGOs)—a new type of IRC § 501(c)(3) organization whose donors may qualify for a dollar for dollar “Education Freedom Tax Credit” (EFTC). Effective January 1\, 2027 (subject to state opt in)\, SGOs can and fund scholarships covering a broad range of K–12 educational expenses for students. On October 1\, 2026\, the IRS released the much-anticipated Treasury Regulations in two parts (RIN  1545-BR97 and (RIN  1545-BS17). These regulations interpret the ambiguous provisions of the EFTC and detail what rules SGOs will need to follow to begin receiving donations that qualify for tax credits.
