Learn about the potent statutory exemption protection of Cal. Code Civ. Proc., § 704.115(b) for Private Retirement Trusts (“PRT”) by taking a deep dive into the case law and the legislative history of Cal. Code Civ. Proc., § 704.115(b), which allows California residents to convert their “exposed” personal assets to “exempt” private retirement assets. We will:
- discover the meaning behind the phrase “retirement purpose” by comparing and contrasting the holdings of various courts that have been tasked with examining the totality of the circumstances to determine whether a retirement plan is designed and used for retirement purposes
- discuss how to strategize the creation of your plan based on judicial guidance stemming from particular fact-based scenarios
- talk about circumstances that will negate the validity of the plan
